L9: WHAT IS THE BASIS FOR THIS SUIT?
CB: The Utah State School Board failed to follow the law in adopting these new standards. State law requires the Board to consult with parents, teachers, and other groups of affected people, and also follow administrative rule making procedures (which allows for a standard public comment period). They did neither.
L9: DO YOU SEE THIS IMPLEMENTATION PROCESS AS HAVING BEEN AN INTENTIONALLY IN-THE-DARK-RAM-ROD PROCESS, OR JUST AN OVERSIGHT?
CB: From our research, we believe the Board has never followed the required rule making process. Further, the reason they didn't consult with people partly has to do with the fact that they were pursuing a federal grant (Race to the Top) with a tight deadline, so they had to hurry their vote along in order to qualify.
L9: WHAT IS THE ULTIMATE OBJECTIVE OF THE SUIT? AN APOLOGY, IMPROVEMENT FOR THE FUTURE, A COMPLETE ROLLBACK OF EVERYTHING IMPLEMENTED THROUGH THIS PROCESS?
CB: The lawsuit seeks: "an order enjoining the Board from further implementing Common Core in Utah’s public schools, from requiring Utah’s public schools to further adopt or abide by Common Core, and from enforcing Common Core in Utah’s public schools."
L9: HOW DO YOU RESPOND TO THE USOE REPRESENTATIVES THAT ARE SAYING THE SUIT IS A POLITICAL PLOY AND DISTRACTION THAT WILL HARM THE KIDS?
CB: The Common Core has never been researched. The Board argues that it has to first be implemented before it can be researched—effectively subjecting hundreds of thousands of children to pedagogical experimentation. Of course, any government agent on the defense is going to try to dismiss a challenge as a "political ploy." It's a pathetic and tired tactic.
L9: WE UNDERSTAND THIS HAS BEEN A LONG PROCESS FOR LIBERTAS TO GET THIS POINT OF BEING READY TO FILE THE SUIT. WHAT HAS BEEN INVOLVED IN THE PREPARATION?
CB: Months of research. We've identified other violations of the law, but decided for purposes of this lawsuit to focus only on these two (that deal with public notice and input).
L9: USOE EXPLAINS THAT ITS STATE CORE IS NOT THE COMMON CORE. WHAT ARE THE PROBLEMS YOU HAVE WITH THE STATE CORE AND COMMON CORE THAT MAKES THIS FIGHT SO VITAL AND THAT PARENTS MUST BE AWAKE TO?
CB: This lawsuit sidesteps any concern regarding Common Core itself, focusing instead on the process. If, after being fully informed, Utahns want to bind themselves to the Common Core, then so be it. But that public buy-in didn't happen, and we believe it should have. Thus, the lawsuit.
L9: ARE THERE OTHER STATES THAT HAVE SERVED AS A MODEL FOR WHAT YOU ARE DOING? WHAT CONTACT HAVE YOU HAD, OR DO YOU EXPECT, BY OTHER ORGANIZATIONS AND STATES TO FOLLOW YOUR LEAD ELSEWHERE?
CB: We've been charting our own course on this, however the day after we filed suit, a similar lawsuit appeared in Louisiana that focuses on the process and public input as part of the Common Core rollout.
L9: HOW CAN PEOPLE IN THE STATE HELP SUPPORT YOUR WORK? GETTING THE WORD OUT, PLAINTIFFS, DONATIONS, ETC?
CB: We've set up a website, www.CommonCoreLawsuit.com, where people can go to read the text of the suit, to get updates and support the lawsuit.
The hour is grave because of what we have forgotten.
And now there are two (er, three?). Did it matter which? After watching the debates, it seems being AGAINST Liberty is now a campaign technique. And the winners are . . . (not the Bill of Rights).
Target date is 2030
Take a failed issue. Give it a righteous new name. Get people begging for government salvation. Ram the details through in secrecy. Paranoid indeed.
